To realize a national legal development goal that is planned, integrated, and sustainable, the Indonesian government enacted Law (UU) Number 13 of 2022. This regulation serves as the second amendment to Law Number 12 of 2011 regarding the Formation of Laws and Regulations. The primary objective is to ensure legal certainty and uphold the mandate of the 1945 Constitution, placing sovereignty firmly in the hands of the people. By prioritizing Legislative Integrity, this law modernizes the mechanism of law-making—from planning to promulgation—while emphasizing Meaningful Participation as a core democratic pillar.
This law also serves as a formal follow-up to the Constitutional Court Decision (No. 91/PUU-XVII/2020), providing the necessary legal basis for the “Omnibus” method and digital legislative processes.

To achieve Legislative Integrity, UU 13/2022 introduces several strategic improvements to ensure that every regulation is robust, technically sound, and reflective of the community’s needs. Key enhancements include:

  • The Omnibus Method: A standardized approach to consolidating multiple regulatory topics into a single legal instrument, integrated from the planning stage.
  • Technical Error Correction: Establishing a formal mechanism to fix clerical or technical errors after parliamentary approval but before presidential ratification.
  • Electronic Law-Making: Legalizing the use of digital technology in the drafting and processing of regulations to increase efficiency.
  • Academic Paper Refinement: Improving the quality of Naskah Akademik through advanced methodologies like Regulatory Impact Analysis (RIA) and ROCCIPI.

The Three Pillars of Meaningful Participation

A significant highlight of UU 13/2022 is the reinforcement of Meaningful Participation. To ensure that community involvement is not merely a formality but a substantial contribution to the democratic process, the law mandates three essential prerequisites:

  1. Right to be Heard: The public must have accessible channels to voice their opinions on a draft regulation.
  2. Right to be Considered: Public input must be analyzed and taken into account during the deliberation process.
  3. Right to be Explained: The government and legislature are obligated to provide answers or explanations regarding why specific public inputs were or were not adopted.

Scientific Rigor in Legislation

Under the new guidelines in Lampiran I and II, the formation of laws, provincial regulations, and regency regulations must be supported by analytical methods that assess the real-world impact on society and state finances. By utilizing RIA (to measure economic/social impacts) and ROCCIPI (to analyze the behavior and capacity of affected parties), the state ensures that Legislative Integrity leads to regulations that are not only legally valid but also effective and beneficial for the citizenry.
