Law Number 4 of 2024 concerning Maternal and Child Welfare in the First 1,000 Days (HPK) Phase states that Maternal and Child Welfare is a condition in which the basic rights and needs of mothers and children are met. This includes physical, psychological, social, economic, spiritual, and religious aspects, enabling them to develop and participate optimally according to their social roles within the community.
The First 1,000 Days of Life Phase refers to the period starting from the formation of the fetus in the womb until the child reaches 2 (two) years of age.
Principles of Maternal and Child Welfare
The implementation of Maternal and Child Welfare is based on the following inclusive principles:
- Faith and piety to God Almighty;
- Justice;
- Gender equality;
- Protection;
- Benefit;
- Empowerment;
- Integration;
- Transparency;
- Accountability;
- Sustainability;
- Best interests of the Mother and Child; and
- Non-discrimination.
Objectives of Law Number 4 of 2024
According to Article 3, the implementation of Maternal and Child Welfare aims to:
- Fulfill basic needs;
- Develop superior human resources and future generations;
- Realize a better quality of life for physical and spiritual well-being;
- Protect from violence, discrimination, neglect, exploitation, treatment that degrades human dignity, human rights violations, and other unlawful acts; and
- Ensure a sense of safety and comfort.
Rights of the Mother
Every Mother is entitled to:
- Health services that are standardized, safe, high-quality, and affordable before, during, and after pregnancy, supported by health insurance;
- Nutritional guarantees from pregnancy until the child is 6 (six) months old;
- Family planning services;
- Social welfare fulfillment;
- Support from a partner, family, or professional companions during pregnancy, miscarriage, childbirth, and postpartum;
- A sense of safety and protection from all forms of violence, discrimination, and exploitation;
- Consultation, psychological services, or religious guidance;
- Education and skill development regarding childcare, feeding, and child growth;
- Inclusive treatment and facilities in public infrastructure; and
- The opportunity to be a breast milk donor for children who cannot receive milk from their biological mother due to specific medical conditions.
Rights of the Child in the First 1,000 Days
Under Law Number 4 of 2024, every child in the 1,000 HPK phase has the right to:
- Live, grow, and develop optimally;
- Identity and citizenship status;
- Exclusive breastfeeding from birth until 6 (six) months, continuing until 2 (two) years, unless medically contraindicated;
- Nutritious complementary foods (MP-ASI) from 6 (six) months to 2 (two) years;
- Nutritional guarantees from birth until 2 (two) years;
- Health and nutrition services tailored to their age and special developmental needs;
- Social welfare fulfillment;
- The best sustainable care and upbringing;
- Expression, play, and interaction with peers; and
- A supportive environment for holistic growth.
Obligations of Parents (Mothers and Fathers)
Both parents are obligated to:
- Maintain health from pre-conception through the postpartum period;
- Ensure the child’s survival and optimal growth;
- Provide exclusive breastfeeding (0–6 months) and appropriate complementary foods until 2 years;
- Provide balanced nutrition and age-appropriate stimulation;
- Regularly monitor the child’s growth at healthcare facilities;
- Nurture, educate, and protect the child with compassion;
- Instill spiritual values and good character;
- Maintain a healthy, safe, and supportive environment; and
- Fulfill child rights and ensure specific protection for the child.
